By creating an account or using Escrowr, you agree to these terms. Please read them carefully before trading.
1. Definitions
"Platform" means Escrowr Technologies Pvt. Ltd. and its web application at escrowr.in. "Trade" means a single USDT⇄INR escrow transaction. "Escrow" means the TRC20-network smart-wallet holding USDT pending trade completion. "KYC" means Know Your Customer verification as required by PMLA.
2. Eligibility
You must be (a) a natural person 18 years or older; (b) a resident of India; (c) not a politically exposed person (PEP) without enhanced due diligence clearance; (d) not on any OFAC, UN, or PMLA sanctions list. Corporate entities must provide GSTIN, CIN, and authorized-signatory KYC.
3. KYC obligations
You must provide accurate, current, and complete KYC information. PAN, government photo ID, liveness, and bank account details must match exactly. Providing false KYC information is a criminal offence under PMLA Section 12 and IPC Section 420. We reserve the right to suspend any account pending re-verification.
4. Trade rules
(a) Sellers must deposit exact USDT within 60 minutes of trade creation. (b) Buyers must transfer exact INR within the window set by the seller. (c) Submitting a false UTR or payment proof is fraud under IPC Section 420 and PMLA. (d) Rates must be within ±2% of the live market rate. (e) Structuring trades to avoid reporting thresholds is prohibited under PMLA Section 2(u).
5. Escrow mechanics
The Platform holds USDT in a per-trade derived HD-wallet address. The Platform is the custodian during the trade window only. USDT is released to the buyer upon seller confirmation, or returned to the seller upon expiry/refund decision. Platform is not liable for Tron network outages or delays beyond 30 minutes.
6. Dispute resolution
Disputes are resolved exclusively by the Platform's compliance team. Decision is binding and final. Evidence must be submitted within 24 hours of raising the dispute. Providing fabricated evidence is a criminal offence. Appeals may be made in writing to compliance@escrowr.in within 7 days.
7. Fees
Platform fee: 0.5% of USDT trade value, deducted from seller proceeds at release. Network fee (~0.1 USDT) is passed through at cost. GST at 18% is applicable on platform fees.
8. Prohibited activities
(a) Money laundering or terrorist financing; (b) trading on behalf of third parties not KYC-verified; (c) using mule bank accounts; (d) circumventing AML limits through multiple accounts; (e) using VPNs to mask jurisdiction; (f) automated/bot trading without written permission.
9. Limitation of liability
The Platform is not liable for losses from: (a) Tron network failures; (b) user error in wallet addresses; (c) INR bank transfer delays; (d) force majeure events; (e) regulatory action. Maximum liability is capped at the platform fee collected on the specific trade.
10. Termination
The Platform may suspend or terminate any account at any time for non-compliance with these terms, AML policy, or regulatory requirements. Escrow funds will be handled as per dispute resolution procedures.
11. Governing law
These terms are governed by the laws of India. All disputes are subject to exclusive jurisdiction of courts in Mumbai, Maharashtra.
